Bar Council of India (BCI) Approval & Recognition Rules

Key Legal Framework for Foreign Law Degree Holders

To practice law in courts across India, a candidate holding a foreign degree must meet the statutory criteria laid down by the Bar Council of India (BCI) under the Advocates Act, 1961:

  • Undergraduate Law Degree (LLB / JD Equivalent):
    • The foreign university/institution must be recognized by the Bar Council of India.
    • The foreign law degree must be a primary qualifying law degree (such as a 3-year LLB or Juris Doctor) that grants the right to practice law in the host country.
  • Master of Laws (LLM) Degrees:
    • An LLM from a foreign university (USA, UK, Europe, etc.) is an academic postgraduate qualification. An LLM alone does NOT entitle a candidate to practice in Indian courts unless they already hold an Indian LLB or a BCI-recognized foreign undergraduate law degree.
  • Qualifying Exam for Foreign Graduates:
    • Graduates with a recognized foreign law degree must clear the BCI Examination for Foreign Law Graduates followed by enrollment with a State Bar Council and clearing the All India Bar Examination (AIBE).
